1. Scope of Application
1.1 These Terms and Conditions apply to all contracts concluded between Yuliia Halata – Visual Artist (hereinafter referred to as “Seller”) and customers via this online shop.
1.2 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
1.3 Any conflicting terms and conditions of the customer shall not apply unless expressly agreed to in writing by the Seller.
2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
2.2 By clicking the “Buy Now” button, the customer submits a binding offer to conclude a purchase contract.
2.3 The contract is concluded when the Seller confirms the order by email or dispatches the goods.
2.4 The contract language is German. This English version is provided for convenience.
3. Prices and Payment
3.1 All prices stated are final prices and include statutory VAT where applicable.
3.2 Shipping costs are charged in addition and are displayed during the checkout process.
3.3 Payment is made using the payment methods offered during checkout (e.g., credit card, PayPal, Shopify Payments).
3.4 The purchase price is due immediately upon conclusion of the contract.
4. Delivery and Shipping
4.1 Delivery is made to the shipping address specified by the customer.
4.2 Delivery times are indicated in the respective product description.
4.3 If a product is unavailable, the customer will be informed without undue delay.
4.4 For consumers, the risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods.
5. Retention of Title
The goods remain the property of the Seller until full payment has been received.
6. Right of Withdrawal
Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you (who is not the carrier) has taken possession of the goods.

by means of a clear statement (e.g., email or letter) of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw.
We may withhold reimbursement until we have received the goods back.
You must return the goods without undue delay and in any event no later than fourteen days from the day on which you inform us about the withdrawal.
You bear the direct cost of returning the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- goods made to the customer’s specifications or clearly personalized,
- sealed goods which are not suitable for return for health or hygiene reasons if unsealed after delivery.
7. Warranty
The statutory warranty rights under German law apply.
8. Liability
8.1 The Seller shall be liable without limitation for damages resulting from injury to life, body or health.
8.2 For other damages, the Seller shall only be liable in cases of intent or gross negligence.
8.3 In cases of slight negligence, the Seller shall only be liable for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.
8.4 Liability under the German Product Liability Act remains unaffected.
9. Intellectual Property
All content of this online shop, including but not limited to images, artworks, designs and texts, is protected by copyright law.
Any reproduction, modification or use without prior written consent is prohibited.
10. Dispute Resolution
The European Commission provides an Online Dispute Resolution platform:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Governing Law
These Terms and Conditions shall be governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections under the law of their country of residence.
12. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
